TERMS & CONDITIONS

Payments: As soon as we receive your non-refundable deposit payment, we will confirm your reservations and at this point all change and cancellation policies will be in effect. We will send you a Finalized Itinerary which will contain all necessary information including confirmation numbers, addresses and phone numbers.

Forms of Payment: We accept credit and debit cards (American Express, Visa, MasterCard and Discover) using the form above.

We also accept Wire transfers, Cashier’s checks, Travelers checks, personal checks and cash as payment. If you would like to make a payment as a wire transfer, please contact your travel specialist to obtain our banking information. Reservations will not be confirmed until full payment has cleared.

Itinerary Changes: For itineraries, once finalized and booked each change is subject to a $100 change fee, as well as any cost increase. Changes are also subject to availability. Please contact us to request any changes to your reservations. For cancellations, please see the section on Cancellations, below.

Visas/Special Permits: You are responsible for obtaining any necessary visas and travel permits for all countries that you will be traveling to or transiting through, and for informing yourself as to which countries/areas within countries require visas and/or special permits. Visa and entry requirements may vary depending on your nationality, the length of your stay, and the purpose of your visit, among other factors. Visa information and visas can be obtained by contacting the Consulate or Embassy of the countries involved. Please also make certain that your passport is valid for at least six months after the latest expected end date of your planned trip, as some countries will not allow entry if your passport will expire sooner. We are not lawyers, and nothing we say should be interpreted as legal advice concerning visas, entry requirements, immigration, or residency.

Health and Safety Matters: You are responsible for determining what, if any, vaccinations or other health or safety precautions are necessary or recommended for your destinations. We are not physicians, and nothing we say should be interpreted as professional medical advice. Government health advisories can be found on the internet at: http://www.cdc.gov and http://www.who.int

Cancellations: Every trip itinerary and its components have particular conditions and policies regarding cancellation. In addition to any cancellation penalties related to non-refundable components (e.g. permits, airfare, hotel, tour, etc.), the following fees will apply - 25% of trip cost 76 days or more prior to travel date and cancellations made within 75 days of travel date are 100% nonrefundable. Our cancellation penalties apply as soon as we have received deposit payment. Please be advised that some reservations, regardless of proximity to check-in date, are completely non-refundable. Cancellations for any reason whatsoever, including medical reasons, death in the family, strikes, wars, weather, natural disasters, airline default or government travel warnings will not entitle you to any refund in the case of nonrefundable reservations. Trip cancellation and interruption insurance is therefore highly recommended.

Responsibility/Release and Assumption of Risk: "I understand and am aware that during the travel itinerary in which I will participate under the arrangements of ABC Travel Co. (hereinafter referred to as the Company), and its agents, associates, affiliated companies, or subcontractors, certain risks and dangers may arise, including but not limited to the hazards of traveling in unsafe areas or under unsafe conditions, the hazards of traveling in politically unstable areas, the dangers of civil disturbance and war, the forces of nature, the negligent or reckless acts or omissions of, and/or the bankruptcy, insolvency or cessation of services by, the Company’s affiliated companies, hotels, tour operators or subcontractors. In consideration of, and as part of the payment for, the right to participate in such travel itineraries, I have and do hereby expressly assume all of the above risks. The terms of this agreement shall serve as a release and express assumption of risk for myself, my heirs, assignees, administrators, executors, and all members of my family, including any minors accompanying me. I have read and fully understand the provisions and the legal consequences of this Release and Assumption of Risk and I hereby agree to all its conditions, especially noting and agreeing to the portion of this provision that releases the Company and its agents, employees, officers, directors, associates, affiliated companies, and subcontractors, to the extent permitted by law, from liability for the negligent or reckless acts or omissions of the Company’s affiliated companies, airlines and subcontractors."

For California customers: Right of California Customer to Make Claim on the California Travel Consumer Restitution Fund. In the event of ABC Travel Co. default, you may be eligible for a refund of up to $15,000 from the California Travel Consumer Restitution Fund. If you were located in California at the time of your purchase, you have a right to make a claim against the fund for a refund of any money paid to ABC Travel Co. that is due because of ABC Travel Co. bankruptcy, insolvency, cessation of operations, or material failure to provide the transportation or travel services sold. The claim must be filed within 60 days (or in some limited circumstances, within one year) after you become aware of your loss. For a claim form and additional information, write to Travel Consumer Restitution Fund, PO Box 6001, Larkspur, CA 94977-6001. For customers located outside California at the time of purchase of travel services: This transaction is not covered by the California Consumer Restitution Fund. You are not eligible to a claim against that Fund in the event of ABC Travel Co.fault.

The following applies to Airfare bookings:

Baggage: Check with your specific airlines. Most domestic US carriers and some international carriers now charge for each piece of checked baggage. For most international flights baggage is limited to a total of 20 kg. (44 lbs.), total of all pieces and items including carryon items. If you plan to check and/or carry on more than 20 kg. of luggage per person on any of your flights, check directly with each airline in advance for their free baggage limits and excess baggage charges.

Reconfirming Flights/Tickets: ABC Travel Co. takes no responsibility for reconfirming your flights or for advising you of airline schedule changes once your tickets have been issued. Standard airline rules in effect in most countries require that international flights must be reconfirmed directly with the airlines concerned at least 72 hours prior to departure of each flight or the airline(s) may cancel your reservations. You should plan on contacting each airline concerned by phone or at a city ticketing office at least three days before your flight to reconfirm and check for any schedule changes. We recommend that you reconfirm each flight, even if the airline says that it is not required.

Airline Default/Involuntary Schedule Changes: We take no responsibility in the event of an airline’s default, cessation of service on a ticketed route or schedule change. Travel insurance that covers airline default is highly recommended.

Trip cancellation and interruption insurance is therefore highly recommended. For the best coverage, travel insurance should be purchased at the same time as your airline tickets.

 

WAIVER OF LIABILITY AND RELEASE

         I hereby acknowledge that I am aware that, during my participation in a Great Safaris tour program, certain risks and dangers may arise, inherent in or associated directly or indirectly with the tour activities, and notwithstanding the presence of trained guides. 

·        Such risks include, but are not limited to, the hazards of traveling in undeveloped areas; wild animals; foreseen or unforeseen terrain or weather issues; travel by boat, train, automobile, bus, aircraft or other means of conveyance; the forces of nature; political or civil unrest; and accident or illness in remote geographic areas without access to rapid evacuation services or medical facilities.

·        I expressly acknowledge that naturally occurring diseases and viruses (including, but not limited to, the currently widespread COVID-19 virus) may be present and actively occurring in all environments. By signing this agreement, I acknowledge the highly contagious nature of COVID-19, and I voluntarily assume the risk for myself and any minors traveling with me, that I or they may be exposed to or infected with COVID-19 while traveling, and that such exposure or infection may result in personal injury, illness, permanent disability or death.

·        I am also aware and understand that Great Safaris will not have liability regarding provision of medical care or the adequacy of any care that may be rendered. 

·        I am also aware that Great Safaris will, at its sole discretion, contract with vendors or service providers to perform certain components of the Tour.

I am voluntarily participating in Great Safaris’ tour program with the knowledge of the dangers involved and hereby agree to accept any risks. I further warrant that I and any family members accompanying me including any minor children are in a sufficiently good physical and mental state to take part in the tour activities having regard to my general state of health, fitness, and medication requirements. 

As lawful consideration for the agreement with Great Safaris, to participate in such trips and activities, I hereby agree that I will not make any  claim against Great Safaris, its directors, shareholders, employees, agents or principals, or sue for bodily injury, emotional trauma, death and/or property damage and/or loss of property, however caused, as a result of my participation in the tour program, notwithstanding that such death or injury, or loss or damage has been occasioned by any loss of care or skill, negligence or other act or omission on the part of Great Safaris, or any vendor or service provider who contracted with Great Safaris. I agree that I will not make a claim against Great Safaris for any claims that may arise from its selection of a tour route, selection of tour guides and/or vendors and/or service providers, all of which may provide components for the Great Safaris tour program. 

I therefore release Great Safaris, its directors, shareholders, employees, agents or principals, from any and all claims, actions and demands which are known or unknown, that I may have arising from my participation in the tour program. I further agree that in my personal/representative capacity, to be bound by the above release and that the above release will be binding on my estate.

Great Safaris will not be liable for travel supplier acts of omissions. Such acts of omissions of travel suppliers, include failure to honor future travel credits, bankruptcy and cessation of services. Great Safaris has no liability for providing a future travel credit in lieu of a refund.

 This Waiver of Liability and Release agreement is entered into on behalf of all members of my family, including minors accompanying me. This agreement is binding on my heirs, legal representatives and assigns. If any portion of this agreement is unenforceable, the remaining portions shall remain in full force and affect.

 I have read and agree to the terms and conditions of this release and I acknowledge that I have read and agree to, by the company’s General Terms and Conditions.

 I understand that travel insurance is available for purchase. This protects against losses resulting from trip cancellation or interruption, medical expenses, emergency medical transportation and baggage/personal effects. Should I decline to purchase travel insurance, I understand that I am assuming any financial loss associated with my travel arrangements which otherwise may have been covered by travel insurance.

·        I, for myself, and any minors traveling with me, and on behalf of my and their heirs, assigns, personal representatives and next of kin, hereby release, indemnify, and hold harmless The Company, its officers, agents, and/or employees (releasees), from any and all claims, demands, losses and liability arising out of or related to any injury, disability, death or any other loss I may suffer due to exposure, infection or spread of COVID- 19, whether arising from the negligence of the releasees or otherwise, to the fullest extent permitted by law.

·        By accepting all of the above and the terms and conditions in their entirety, this release of liability and assumption of risk shall be interpreted in accordance with the laws of the State of California.
